Limited Warranty

Artigwall is committed to producing products that are of high quality and durable. For a list of the Artigwall Products covered by this Limited Warranty (Covered Products) and the Warranty Period applicable to them, please refer to the table in the What are the Covered Products and the applicable Warranty Periods?      Section, below.

                                                                                                                                                                                                                                                                                                                                                    Subject to the conditions and restrictions described in this Limited Warranty, we warrant, to the original purchaser of a Covered Product, that the Covered Product shall be free of defects in both construction materials and workmanship for the applicable Warranty Period.  

This Limited Warranty covers Covered Products purchased in the United States only. If you purchased an Artigwall Product outside the United States, your product may be subject to a separate warranty that is applicable in the country you purchased it.

                                                                                                                                                                                                                                                                                                                                                       THIS LIMITED WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS AND YOU MAY ALSO HAVE OTHER RIGHTS, WHICH VARY FROM STATE TO STATE.

Who is Covered?

 

This Limited Warranty extends only to the customer who (a) originally purchased the Covered Product directly from Artigwall,

(b) is located in the United States. It does not extend to any subsequent owner.

What are the Covered Products and applicable Warranty Periods?

Covered Products are any Artigwall products described in the table below that have been manufactured and sold to you by Artigwall official online store which is artigwall.com.

During the applicable Warranty Period, this Limited Warranty provides remedies for any Covered Product found to have defects in materials or workmanship

(defects introduced during the manufacturing of the Covered Product or any of its component parts that cause the Covered Product to be unsound structurally

or mechanically, or substantially altered in appearance) when used under normal conditions-strong acid-base environment is excluded. (“Defective Products”).

 

 

COVERED PRODUCT

• Artigwall® Hedge Wall Generation III and Artigwall® Hedge Wall Outdoor Ultra: Planter box and Frames

WARRANTY PERIOD

15 years indoor, 5 years outdoor from date of purchase.

PRODUCT-SPECIFIC EXCLUSIONS, CONDITIONS, AND DETAILS (See also What is NOT Covered under this Limited Warranty?)

 

Subject to the exclusions described herein, the Limited Warranty for hedge wall in 201 Steel planter box: planter box covers broken frames, loose joints and welds, and splintering of material and other defects in workmanship and materials that cause the product to be unsound structurally or mechanically, or that substantially alter the appearance of the piece.

Note, however,

• Artigwall artificial boxwood hedge wall 201 Steel planter box is made of powder coated 201 steel which We design as a long lifespan product. While this material is extremely resistant to extreme weather, such as hot summer, cold winter and wet season, and also it is famous for its rust-proof feature, but not mean it never rust.
• If the 201 steel is used in a relatively harsh environment, such as high salt content in the air, and the stainless steel pipe is exposed to acidic substances for a long time, it will also rust. This kind of natural rusting are is not considered as a quality defect, and it is not covered by the warranty.

 

NOT COVERED:

The following will void the subject warranty; This warranty does not cover damage from improper care and cleaning, misuse, abuse, or improper installation which includes, but is not limited to, the following:

• Minor cosmetic cracks
• Minor variations in color or texture of finishes
• Damage to the product due to high wind, sand storms, pets, animals,vandalism, or other sources not related to the initial manufacturing.
• Damage caused by plants (or vegetation of any sort) growing directly upon or in contact with any portion of the product,as well as sap from trees.
• If the product is installed using non-recommended parts and accessories, and/or improper placement of attachment accessories through the product, or anywhere other than through the designated attachment points.
• This warranty does not cover warping, distortion or failure due to an external heat source including, but not limited to a barbecue grill, fire, or reflection from windows, doors, or other objects.

• Artigwall® Hedge Wall Generation III and Artigwall® Hedge Wall Outdoor Ultra: Greenery Boxwood Panel Components

 

WARRANTY PERIOD

 indoor-5 years, outdoor-3 years from date of purchase.

Subject to the exclusions described herein, the Limited Warranty for Artigwall® Hedge Wall Generation III: greenery boxwood panel components covers manufacturer defects, such as improper molding, sizing, or premature cracking which cause the product to become unserviceable due to strength loss from normal usage and exposure conditions, including sunlight and mildew. This warranty does not include labor costs associated with installing replacement Artigwall® Classic Artificial Hedge Mat.

 

NOT COVERED:

 

The following will void the subject warranty; This warranty does not cover damage from improper care and cleaning, misuse, abuse, or improper installation which includes, but is not limited to, the following:

• Damage to the product caused by landscape or gardening equipment, corrosive or other chemicals, and/or high pressure or high mineral content water sprayers or sprinklers.
• Damage to the product due to high wind, sand storms, pets, animals,vandalism, or other sources not related to the initial manufacturing.
• Damage caused by plants (or vegetation of any sort) growing directly upon or in contact with any portion of the product,as well as sap from trees.
• If the product is installed using non-recommended parts and accessories, and/or improper placement of attachment accessories through the product, or anywhere other than through the designated attachment points.
• This warranty does not cover warping, distortion or failure due to an external heat source including, but not limited to a barbecue grill, fire, or reflection from windows, doors, or other objects.

Subject to the exclusions described herein, the Limited Warranty for hedge wall in wooden color extrusion aluminium planter box: wooden color extrusion aluminum planter box covers broken frames, loose joints, cracking, falling-off coating,bubbles on surface,obvious fading,and splintering of material and other defects in workmanship and materials that cause the product to be unsound structurally or mechanically, or that substantially alter the appearance of the piece.

NOT COVERED:

 

The following will void the subject warranty; This warranty does not cover damage from improper care and cleaning, misuse, abuse, or improper installation which includes, but is not limited to, the following:

• Minor cosmetic cracks
• Minor variations in color or texture of finishes
• Damage to the product due to high wind, sand storms, pets, animals,vandalism, or other sources not related to the initial manufacturing.

This warranty does not include labor costs associated with installing replacement Artigwall® Classic Artificial Hedge Mat.

NOT COVERED:

 

The following will void the subject warranty; This warranty does not cover damage from improper care and cleaning, misuse, abuse, or improper installation which includes, but is not limited to, the following:

Stainless steel material parts 15 years indoor, 5 years outdoor from date of purchase.

Subject to the exclusions described herein, the Limited Warranty for hedge wall in wooden color extrusion aluminum planter box: stainless steel components  covers broken frames, loose joints and welds, and splintering of material and other defects in workmanship and materials that cause the product to be unsound structurally or mechanically, or that substantially alter the appearance of the piece.

 

Note, however,

• 201 steel pipe surface has a layer of invisible protective film, if the pipe surface is damaged is easy to rust! The rust caused by the destruction of the protective film due to human reasons caused by improper use and operation is not covered by the warranty.
• If steel is used in a relatively harsh environment, such as high salt content in the air, and the stainless steel pipe is exposed to acidic substances for a long time, it will also rust. This kind of natural rusting are is not considered as a quality defect, and it is not covered by the warranty.

 

NOT COVERED:

The following will void the subject warranty; This warranty does not cover damage from improper care and cleaning, misuse, abuse, or improper installation which includes, but is not limited to, the following:

Subject to the exclusions described herein, the Limited Warranty for boxwood roll & panel and plant wall covers manufacturer defects, such as improper molding, sizing, or premature cracking which cause the product to become unserviceable due to strength loss from normal usage and exposure conditions, including sunlight and mildew. This warranty does not include labor costs associated with installing replacement Artigwall® Classic Artificial Hedge Mat.

 

NOT COVERED:

 

The following will void the subject warranty; This warranty does not cover damage from improper care and cleaning, misuse, abuse, or improper installation which includes, but is not limited to, the following:

Subject to the exclusions described herein, the Limited Warranty for Rattan room divider: Metal Components(Frame) covers broken frames, loose joints, cracking, broken or displaced rattan strands or excessive fading that, in each case, substantially impairs the appearance of the item,and splintering of material and other defects in workmanship and materials that cause the product to be unsound structurally or mechanically, or that substantially alter the appearance of the piece.

NOT COVERED:

 

The following will void the subject warranty; This warranty does not cover damage from improper care and cleaning, misuse, abuse, or improper installation which includes, but is not limited to, the following:

• Minor cosmetic cracks
• Minor variations in color or texture of finishes
• Damage to the product caused by exposure to strong acidic or alkaline chemical liquids.
• If the product is installed using non-recommended parts and accessories, and/or improper placement of attachment accessories through the product, or anywhere other than through the designated attachment points.
• This warranty does not cover warping, distortion or failure due to an external heat source including, but not limited to a barbecue grill, fire, or reflection from windows, doors, or other objects.

WARRANTY PERIOD

3 years from date of purchase.

Subject to the exclusions described herein, the Limited Warranty for Rattan room divider: Plastic Rattan Components covers broken(cracking) or displaced rattan strands or excessive fading that, in each case, substantially impairs the appearance of the item.

NOT COVERED:

 

The following will void the subject warranty; This warranty does not cover damage from improper care and cleaning, misuse, abuse, or improper installation which includes, but is not limited to, the following:

• Minor cosmetic cracks
• Minor variations in color or texture of finishes
• Damage to product caused by sharp knives, scissors or sharp objects scratching.
• Damage to the product caused by exposure to strong acidic or alkaline chemical liquids.
• If the product is installed using non-recommended parts and accessories, and/or improper placement of attachment accessories through the product, or anywhere other than through the designated attachment points.
• This warranty does not cover warping, distortion or failure due to an external heat source including, but not limited to a barbecue grill, fire, or reflection from windows, doors, or other objects.

The following will void the subject warranty; This warranty does not cover damage from improper care and cleaning, misuse, abuse, or improper installation which includes, but is not limited to, the following:

WARRANTY PERIOD

1 year from date of purchase

PRODUCT-SPECIFIC EXCLUSIONS, CONDITIONS, AND DETAILS (See also What is NOT Covered under this Limited Warranty?)

Subject to the exclusions described herein, the Limited Warranty for Other Artigwall Products covers defects in workmanship and materials that cause the piece to be unsound structurally, or substantially alter its appearance, or cause it to become unserviceable.

• NOT COVERED:
• Color changes due to normal exposure to sun and atmospheric chemicals
• Minor variations in color or texture of materials such as color of water bag and wheels
• Within 1 year warranty period, any quality problems of the above mentioned items affecting the use of products will only be replaced and not repaired.

 

 

What must I do to protect my Outer Products?

Artigwall has done whatever we could do to design and make each product to stand up rugged environment, but nothing is infallible. Such as for our hedge wall product, some measures need to be taken to protect it in extreme weather, such as hurricane,rainstorm or and snowstorm weather, it is better to move them into the house or shelter from the wind. Also if they were put in a windy place, it is bette to put water bag or sand into the planter box to add bottom weight, and if use it outdoor permanently, also need to use anchors to fix it onto the ground or floor.

 What is NOT Covered under this Limited Warranty?

• This Limited Warranty does not cover any damage due to:
• Transportation
• Improper Storage
• Improper or negligent use, handling, assembly, or care of Covered Product, including, without limitation, the use of improper cleaning products, sun-tan oils or other chemicals
• Failure to follow the Covered Product instructions or to perform any preventive maintenance
• Modifications
• Unauthorized repair
• Normal wear and tear, corrosion, rust or stains, scratches, or dents, including the rusting or tarnishing of metal materials resulting from abrasive scratches
• Excessive weight placed on the Covered Product, including damage to the frame or legs of Covered Products
• Bursting or cracking of tubing due to exposure to water and freezing temperatures
• Accident, abuse, neglect, theft, vandalism, pets, rodents, fire, flood, wind, hail, lightning, freezing temperatures, extreme temperatures, natural disasters or acts of God of any kind, or other external causes beyond Artigwall’s reasonable control.

 

What are my Remedies under this Limited Warranty?

If we receive a valid claim for a Defective Product within the applicable Warranty Period, we will exchange the Defective Product with a new or refurbished Product rather than repair. If we, determine it is not reasonable to replace the Defective Product, we may choose to refund to you the purchase price paid for the Defective Product, rather than exchange it.

Any replacement product will be warranted for the remainder of the original Warranty Period or thirty (30) calendar days, whichever is longer.

How do I obtain Warranty Service?

To obtain a replacement or refund for a Defective Product under this Limited Warranty (“Warranty Service”), you must  email our Customer Service Department at support@artigwall.com during the applicable Warranty Period. You will need to provide photos and a description of the defect, and also your original order No. and purchase date ect information.

 

Disclaimers; Implied Warranties.

 

TO THE EXTENT PERMITTED BY LAW, THIS LIMITED WARRANTY AND THE REMEDIES SET FORTH ARE EXCLUSIVE AND IN LIEU OF ALL OTHER WARRANTIES, REMEDIES AND CONDITIONS, WHETHER ORAL, WRITTEN, STATUTORY, EXPRESS OR IMPLIED. OUTER DISCLAIMS ALL STATUTORY AND IMPLIED WARRANTIES, INCLUDING WITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE AND WARRANTIES AGAINST HIDDEN OR LATENT DEFECTS, TO THE EXTENT PERMITTED BY LAW. IN SO FAR AS SUCH WARRANTIES CANNOT BE DISCLAIMED, OUTER LIMITS THE DURATION AND REMEDIES OF SUCH WARRANTIES TO THE DURATION OF THIS EXPRESS LIMITED WARRANTY AND, AT ARTIGWALL’S OPTION, THE REFUND AND REPLACEMENT REMEDIES DESCRIBED ABOVE. SOME STATES DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU.

 

 

Limitation of Liability.

**EXCEPT TO THE EXTENT PROHIBITED BY APPLICABLE LAW, ARTIGWALL SHALL NOT BE LIABLE FOR ANY INCIDENTAL, INDIRECT, SPECIAL, OR CONSEQUENTIAL DAMAGES, OR ANY LOSS OF PROFITS, REVENUE OR DATA, RESULTING FROM ANY BREACH OF EXPRESS OR IMPLIED WARRANTY OR CONDITION, OR UNDER ANY OTHER LEGAL THEORY, EVEN IF OUTER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES AND REGARDLESS OF THE FORM OF ACTION WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE) OR ANY OTHER LEGAL OR EQUITABLE THEORY NOR, UNDER ANY CIRCUMSTANCES, SHALL ARTIGWALL’S LIABILITY UNDER THIS LIMITED WARRANTY EXCEED THE ACTUAL AMOUNT PAID BY YOU FOR THE DEFECTIVE PRODUCT. **

 

Some jurisdictions do not allow the exclusion or limitation of special, indirect, incidental or consequential damages, so the above limitation or exclusion may not apply to you.

 

Governing Law; Severability.

This Limited Warranty will be governed by the laws of China, without giving effect to any conflict of laws principles that may provide for the application of the law of another jurisdiction. If any term of this Limited Warranty is held to be illegal or unenforceable, the legality or enforceability of the remaining terms will not be affected or impaired.

What can I do in the event of a Dispute with Artigwall in connection with this Limited Warranty?

Any disputes between you and Artigwall related to this Limited Warranty or the Products will be governed by the then-current dispute resolution procedures in the Artigwall Terms of Use.
